NYS Juror Pay to Increase Effective June 8

Beginning June 8, 2025, the daily rate for jury duty in New York state will increase from $40 to $72. As was the case before, employers with 11 or more employees must pay employees the daily rate for each of their first three days of jury service. Employees of smaller employers are paid the daily rate by the state.

In the FAQs, it also covers use of paid time off, schedule changes, making up lost time, working after jury duty finishes for the day, etc.

 

A reminder that per FLSA salary basis rules, exempt employees should be paid their full salary for any work week during which they are off for jury duty service, though employers can offset the amount the employee receives from the state. If an exempt employee is off work for an entire workweek and does no work at all during that time (such as checking and responding to emails or texts, returning phone calls, etc.), then no pay is required for that work week. However, that is not without risk so be sure to discuss proper protocols with your attorney before taking that route.

 

Employer Action Items
- Ensure that your payroll department is made aware of the increase from $40 to $72 per day.

- If this level of detail is included in your employee handbook policy on jury duty service, be sure to update it.

- As employees go out for jury duty service, give them a heads up on company protocol and send them a copy of your policy, share information with nonexempt employees and their managers on how to report on their timecard or in your timekeeping system, etc.

 

A 3005C was signed by the governor on May 9, 2025 and the jury duty pay increase goes into effect 30 days from the signing.
