Reminder: NYS Minimum Wage and Salary Threshold Changes Effective 12/31/22

date
November 22, 2022

Employers are reminded that the next New York State minimum wage increase to $14.20 per hour is effective December 31, 2022 but only for employers who are outside of the NYC, Long Island, and Westchester County areas (their minimum wage is already at $15 per hour).  Annual increases will continue to be published by the Commissioner of Labor on or before October 1 each year on the NYS Department of Labor minimum wage website.

In addition to the minimum wage increase, based on the proposed regulatory text, the NYS salary threshold for the executive and administrative exemptions is also expected to increase December 31, 2022 to $1,064.25 per week and again, only for employers who are outside of the NYC, Long Island, and Westchester County areas as they are already at $1,125 per week.

While the NYS salary threshold does not apply to the professional exemption, the federal Fair Labor Standards Act (FLSA) threshold applies to most jobs that fall under the professional exemption category and is currently $684 per week.  Jobs such as teachers, doctors, and lawyers do not have a salary requirement.
