NY HERO Act Safety Committees Guidance

As of this writing, NYS has not yet issued guidance on Section 2 of the NY HERO Act.  Under Labor Law §27-d and effective November 1, 2021, employers of 10 or more employees must permit the establishment of joint employer-employee workplace safety committees. Greater Rochester Chamber will notify members once the guidance has been issued.

As a reminder, Section 1 of the NY HERO Act requires every private employer in New York State to adopt a safety and health plan to protect employees from airborne infectious diseases. So far, the state has issued standards, sample templates, and FAQs pertaining to Section 1. Employers should ensure they’ve met the requirements regarding Section 1 of the NY HERO Act and be prepared should employees wish to establish a workplace safety committee as part of Section 2.
